  Today is the sad anniversary of Roe v Wade.  Today close to 200,000 will march in D.C. to protest this decision.  Please pray for their efforts.  The media will not report much about this March and its successful turn out.  They most likely will focus on the 50 or so pro-aborts that turns out and lable the march something like "the march against choice" or something ridiculously politically correct like that.

Death, it is thought, is an unmitigated evil, the very antithesis of all that is good.

  Death is to be warded off by exercise, by healthy habits, by medical advances. What cannot be halted can be delayed, and what cannot forever be delayed can be denied. But all our progress and all our protest notwithstanding, the mortality rate holds steady at 100 percent.

  Death is the most everyday of everyday things. It is not simply that thousands of people die every day, that thousands will die this day, although that too is true. Death is the warp and woof of existence in the ordinary, the quotidian, the way things are. It is the horizon against which we get up in the morning and go to bed at night, and the next morning we awake to find the horizon has drawn closer. From the twelfth-century Enchiridion Leonis comes the nighttime prayer of children of all ages: "Now I lay me down to sleep, I pray thee Lord my soul to keep; if I should die before I wake, I pray thee Lord my soul to take."   EHarmony was founded by an Evangelical Christian as a private matchmaker for women and men.  Since New Jersey has "sexual orientation" as a civil right, One homosexual person from New Jersey was able to get EHarmony to change its beliefs and provide a homosexual alternative.  THIS IS A PRIVATE BUSINESS!  This once again prove the lie by radical homosexuals that this isn't about imposing on other people's religion or beliefs.  After Prop 8 passed and the other Marriage Amendments, the first places attacked were churches (and Mormon Temples).  The radical homosexual agenda is to force moral acceptance of their lifestyle choice--both publicly AND privately.

  It's very disappointing EHarmony settled--they should have gone to the mat on this.

  The ruling essentially states that a Florida law that states a student must get parental permission to opt out of standing and reciting the Plege Of Allegiance trumps the students 1st Amendment Rights to not say it if the student themselves do not want to say it, but the parent does. 

  The part that is troubling is that the 11th Circuit did not write a very strong opinion.  We predict that there will be more litigation on this issue, which is unfortunate.

  In opening his speech, Coach Holtz shares how he came to know of the Thomas More Law Center:  

  “When the gentleman called me about coming here, I said, if [Coach] Rick Forzano recommends it, I’ll be there – I owe so much to him.  And so I came up here because of Rick Forzano, but after I got all of the information and started reading about the Thomas More [Law Center], I would have been here anyway.  What you’re doing is absolutely tremendous, and I’m glad… I’m glad I became aware of it.”

  About Coach Holtz

  Named head coach at the University of Minnesota in 1984, Coach Holtz said he would spend the rest of his career there unless he had the chance to become head coach at Notre Dame.  That offer came in 1986, and Coach Lou Holtz quickly rebuilt a struggling program as head coach at the University of Notre Dame.  He stayed there until retiring after the 1995 season and soon becoming a television sports commentator.  He came out of retirement in 1999 in response to an offer to coach at the University of South Carolina, whose football team had gone 1-10 that year.  After three years, Coach Holtz had revived the team and won back-to-back Outback Bowl victories against Ohio State.  In 2004, Coach Holtz retired for the second time, and today continues as a football commentator for ESPN and a motivational speaker.

  This is the reality of the homosexual lifestyle--not the pretty pictures of "marriage" the MSM puts out.  This is what the homosexual agenda wants hidden until they are a protected class, then if your try to enforce decency laws you will be sued for violating their civil rights.

  I also want to remember the sacrifices of Captain Michael Martino, USMC, and Major Gerald Bloomfield, USMC, who died in defense of their country.  Now the ACLU has filed a lawsuit to prevent their families from memorializing their sacrifices at the foot of the Mt Soledad Cross, a nationally recognized veterans’ memorial.

  On that day soldiers, sailors, Marines, and airmen braved the horrendous shelling of German shore batteries to storm the beaches at Normandy and bring down Hitler and Nazi Germany.

  More than 2,500 American troops died on the beaches that day.

     

  As President Roosevelt said in his prayer, broadcast nationwide on D-Day, this was a battle "To Preserve our Republic, our religion, and our civilization."

  The President asked for the blessings of Almighty God to be upon American troops as they landed that day on the beaches of France…

  We are in a similar battle today. 

  And so, let us not only take the time to remember the heroic sacrifices of our military 64 years ago, but also to remember the heroic sacrifices our combat men and women are making in Iraq and Afghanistan today. 

  Let us take this time pray for our troops who have died in battle, and for their loved ones who still mourn their great loss.

  Finally, let us also pray for the thousands more who are in hospitals and homes still suffering the wounds of these wars.

  The Frankenmuth issue made news several weeks ago when one citizen of the town said he was "offended" by the "Luther Rose" in the City Shield, which has a cross in the center of it.  This lead to a raucus city council meeting.  Eventually this individual backed down, but the good ole "American's United for Separation of Church and State" have been agitating as of late.  The City Council voted to retain TMLC to help preserve their VERY unique city.  Frankenmuth was founded in 1845 by Lutheran farmer missionaries.  It has been able to maintain its German heritage in the town.  Many may know of Frankenmuth also because of 'Bronners'--the largest Christmas store in the world.

  Now the prosecutors need to show that this unlawful command influence (the mortal enemy of the military justice system) will Not effect LtCol Chessani's trial.  The Military Judge also told us and the prosecutors to come prepared to discuss remedies.  The only remedy for Col Ewers--a lawyer that ghost wrote the Bargewell report and has already come to a judgement on LtCol Chessani's guilt, who also inappropriately advised General's Mattis and Helland on the Haditha cases (A command he was not the lawyer for as well)--is to dismiss the case and start the whole thing over again from the beginning with a new convening authortity--probably the 3 star in Hawaii--Marine Corps Forces Pacific Command LtGen Goodman.

  In yesterday’s ruling striking down Proposition 22, defining marriage as the union of a man and woman, the California Supreme Court ruled our marriage laws are discriminatory.  California’s narrow 4-3 majority thus parted company with most other American courts which have been able to distinguish an ancient and honorable idea -- that marriage requires a husband and a wife -- from an unconstitutional act of bigotry.

  It was just eight years ago that more than 60% of Californians voted for Proposition 22. Yet, yesterday four (out of seven) members of the California Supreme Court vetoed the will of 4.6 million Californians, equating the common-sense understanding of marriage as the union of husband and wife with the racial bigotry of Jim Crow laws.   

  This didn’t have to happen. Over the past decade, at least nine state and federal courts have upheld marriage laws defining marriage as the union of  a man  and  a woman.    Instead of joining these respected courts in upholding marriage, the California Supreme Court’s narrow majority simply stepped in and ordered the issuance of marriage licenses to same-sex couples, rewriting the California marriage statutes by judicial fiat.  

  Three justices, Baxter, Chin and Corrigan, declined to go along with the majority's overreaching decision.  In his dissent, Justice Baxter pointed out:

  "Plaintiffs seek and the majority grants a new right to same-sex marriage that only recently has been urged upon our social and legal system. Because civil marriage is an institution historically defined as the legal union of a man and a woman, plaintiffs could not succeed except by convincing this court to insert  in our Constitution an altered and expanded definition of marriage -- one that includes same-sex partnerships for the first time.  By accepting that invitation, the majority places this controversial issue beyond the realm of legislative debate and substitutes its own judgment in the matter for the considered wisdom of the people and their elected representatives."

  Similarly, Justice Corrigan observed:

  "What is unique about this case is that plaintiffs seek both to join the institution of marriage and at the same time to alter its definition. . . . From the beginning of California statehood, the legal institution of marriage has been understood to refer to a relationship between a man and a woman.  The people are entitled to preserve this traditional understanding in the terminology of the law, recognizing that same-sex and opposite sex unions are different."

  In its ruling yesterday, the majority applied the strictest form of constitutional  review.  To reach such heightened scrutiny, the Court became one of the first courts in the country to accord sexual orientation the same constitutional protection as race.   

  Anticipation of  this ruling spurred more than 1.1 million Californians to sign a petition to put the language of Proposition  22 into the state constitution where it will be safe from judicial radicals.  These signatures are awaiting official certification by the Secretary of States’ office and the constitutional amendment will then be placed on the ballot.

  Only one other American state recognizes the right the majority announces today. So far, Congress, and virtually every court to consider the issue, has rejected it. Nothing in our Constitution, express or implicit, compels the majority’s startling conclusion that the age-old understanding of marriage —an understanding recently confirmed by an initiative law — is no longer valid. California statutes already recognize same-sex unions and grant them all the substantive legal rights this state can bestow. If there is to be a further sea change in the social and legal understanding of marriage itself, that evolution should occur by similar democratic means. The majority forecloses this ordinary democratic process, and, in doing so, oversteps its authority....
  
  But a bare majority of this court, not satisfied with the pace of democratic change, now abruptly forestalls that process and substitutes, by judicial fiat, its own social policy views for those expressed by the People themselves.Undeterred by the strong weight of state and federal law and authority, the majority invents a new constitutional right, immune from the ordinary process of legislative consideration. The majority finds that our Constitution suddenly demands no less than a permanent redefinition of marriage, regardless of the popular will....
  
  I cannot join this exercise in legal jujitsu, by which the Legislature’s own weight is used against it to create a constitutional right from whole cloth, defeat the People’s will, and invalidate a statute otherwise immune from legislative interference. Though the majority insists otherwise, its pronouncement seriously oversteps the judicial power. The majority purports to apply certain fundamentalprovisions of the state Constitution, but it runs afoul of another just as fundamental— article III, section 3, the separation of powers clause. This clause declares that “[t]he powers of state government are legislative, executive, and judicial,” and that“[p]ersons charged with the exercise of one power may not exercise either of the others” except as the Constitution itself specifically provides. (Italics added.)

  History confirms the importance of the judiciary’s constitutional role as a check against majoritarian abuse. Still, courts must use caution when exercising the potentially transformative authority to articulate constitutional rights. Otherwise, judges with limited accountability risk infringing upon our society’s most basic shared premise — the People’s general right, directly or through their chosen legislators, to decide fundamental issues of public policy for themselves.

  Judicial restraint is particularly appropriate where, as here, the claimed constitutional entitlement is of recent conception and challenges the most fundamental assumption about a basic social institution.

  The majority has violated these principles. It simply does not have the right to erase, then recast, the age-old definition of marriage, as virtually all societies have understood it, in order to satisfy its own contemporary notions of equality and justice.

  It would seem hard to top the Massachusetts’s Supreme Court’s judicial activism, but the California Supreme Court took it to a whole new level by mandating same-sex marriage now.  This ruling further calls into question the Constitution’s guarantee of a Republican form of government.  The whole concept of ‘separation-of-powers’ is out the window in California.  This makes the Thomas More Law Center’s decision on how to draft the marriage amendment language in Michigan that much more prescient.

  Charles LiMandri, our West Coast Director has been named the General Counsel of the National Organization For Marriage.  This is the group that we supported that gathered over a million signatures to put traditional marriage back in the CA Constitution on November.  Remeber, just 8 years ago the people voted over 60% to define traditional marriage in CA.  This overreach by these four people will have the opposite effect they desired.  This will galvanize the will of the people to pass the Constitutional initiative in November.  We have 30 days until this is implemented--we will try and get a stay by the court before then.

  TMLC has said from the begining that there was no Law of War violation and that is why LtCol Chessani did not report one.  Now he is going to be criminally judged on whether that true belief was reasonable.  It's perverse.

  …..”If one ignorant of military matters is sent to participate in the administration of the army, then in every movement there will be disagreement and mutual frustration and the entire army will be hamstrung.”

  And as Chang Yu said in 815-817 (+/-) AD:  “In recent times court officials have been used as Supervisors of the Army and this is precisely what is wrong”!

  AMAZING that the Chinese knew what “hobbles an army” almost 3,000 years ago and THIS IS EXACTLY WHAT IS GOING ON TODAY!

  The Military Judge nixed our motion to depose Murtha and get some additional discovery.

  We plan on filing many more motions for the April 15th motions hearing date to include:  unlawful command influence, selective prosecution, a motion to reconsider the evidence denial, and many others.  We are alos looking into appealing some of these decisions considering the denial of the Murtha deposition and if we lose the reconsideration of the evidence we need to fully defend LtCol Chessani before the trial starts on April 28th.

  We know there has been dialogue for some time between the Catholic Church and the Anglican Church about the possibility of it coming back into communion with the Holy See.  Perhaps some day, but the Church of England is in big trouble and its Archbishop's recent comments on Sharia law do not help. 

  Our point about posting the story of the young Prince was more about service to ones country and not hiding behind privlege.  That's a good thing when the USA and England are fighting a common foe of radical Islam that wants to convert or subjigate all of Western Civilization.

  The ongoing effort to save preborn babies from the culture of death is akin to the epic battle between David and Goliath. While the pro-life movement struggles just to maintain its grassroots support base, the massive and powerful culture of death has access to all of the money, political power and propaganda it could ever want.

  At least David had the nerve to show up for the fight. Right now, in Colorado, a 20-year-old law student has taken up David's sling and is prepared to throw the deadly stone while some self-professed pro-life leaders, politicians and clergymen cower because they believe that "now is not the right time."

  In November 2007, Kristi Burton, founder of Colorado for Equal Rights, won an important victory in the state supreme court allowing her to move forward with Proposed Initiative 36. The initiative simply states that "the terms 'person' or 'persons' shall include any human being from the moment of fertilization." This initiative is the lynchpin for restoring the right to life for all preborn babies, because in the U.S. Supreme Court's Roe v. Wade decision, Justice Harry Blackmun wrote, "If this suggestion of personhood is established, the appellant's case, of course, collapses, for the fetus' right to life would then be guaranteed specifically by the [14th] Amendment."

  Over the past 35 years, nearly 50,000,000 preborn babies have been legally butchered in their own mothers' wombs. The most we have to show for our effort to stop this carnage is an alleged ban on the heinous practice of partially delivering a baby, stabbing him or her in the back of the head and then sucking his or her brains out. Hailed by some as a pro-life victory, the so-called ban on partial-birth abortion isn't truly a ban because the Supreme Court decision itself included instructions permitting doctors to circumvent the ban by injecting the baby with poison before completing the grisly procedure. What is so completely baffling, however, is that organizations like the National Right to Life Committee will pop a champagne cork for a ruling that won't stop a single abortion, but will not support or will even directly oppose the personhood initiative – which would directly end all abortions – because they claim that "now is not the right time."

  Some may ask, "If now is not the right time to save babies, when is?" But it's more appropriate to ask, "Why not now?' What do pro-life leaders, politicians and clergymen have to lose by acting now instead of waiting for "the right time"? If the initiative fails, do we admit defeat, tell the babies we're sorry we couldn't do better, pack up and go home? How many amendments and legislative measures are voted upon only once before being passed? The answer is less than one percent! If the initiative fails, you start over and try again and you keep trying until it works. It is hard, tedious and frustrating work, but when compared with the suffering of innocent preborn children who face dismemberment and death, the decision is an easy one. Only those locked in their lofty ivory towers, comfortable with merely drawing a salary to do "pro-life" work, remain silent or oppose real pro-life measures while they wait for "the right time."

  There is no "right time." David went into battle against Goliath without military or combat training and without a sword, shield or helmet. He carried only a sling and some rocks. He was a mere boy and the timing was as much against him as his size and strength. But his courage and faith in God led to victory. In truth, the victory over the culture of death will not be ours to claim, just as the timing is not ours to decide.   There has been a fair share of commentary written on the Georgia Bishops and their public opposition to the proposed personhood bill (HR 536). In fact the power of the opposition of these bishops combined with the testimony against the bill given by a representative of the Georgia Catholic Conference ultimately killed the bill—at least for now.

  Some say it was the tactical question that became the crux of the Bishops’ opposition. In fact in their document, “Reflections on Georgia House Resolution 536,” the Bishops opine that passage of the Human Life Amendment could result in law suits, and they comment as follows:

  Legal experts agree that the current Supreme Court would, at best, decline to hear the case, and at worst, use the opportunity to reaffirm the right to abortion yet another time. The more times the Supreme Court’s abortion decisions are affirmed, the more difficult it becomes to obtain further hearings from the Court and to expect decisions to end abortion.

  In other words, Georgia’s bishops have access to a crystal ball that has revealed to them what will happen in the future of HR 536 moves ahead today.

  Further, the bishops declare that while personhood is a key part of Church teaching, the fact is that the federal constitution has to be amended, not the Georgia constitution, because “abortion is legal in Georgia because the U.S. Supreme Court declared that the ‘right’ to abortion is contained in the U.S. Constitution. Thus, the federal constitution is the problem, not the state Constitution.”

  If we might be so bold, this makes no sense at all. Please allow us to make a point that seems to have been totally avoided in the Georgia bishops’ rush to condemn House Resolution 536. The purpose of the proposed Georgia Constitutional Amendment is to bring to the attention of the electorate, and subsequently the judiciary, the simple fact that while the act of abortion has been decriminalized, it would not continue to be so if the laws defined a person as someone who exists from the point when his life is created: fertilization/conception.

  The purpose of the proposed Georgia Constitutional Amendment is to answer directly what Justice Harry Blackmun said in the initial Roe v. Wade decision:

  [If the] suggestion of personhood [of the preborn] is established, the [abortion rights] case, of course, collapses, for the fetus’ right to life is then guaranteed specifically by the [14th] Amendment.

  This single line, taken from a U. S. Supreme Court decision that was written by the most avid, pro-abortion Supreme Court justice in our history, should be a guiding light for every tactical move made by anyone in a position to choose such maneuvers. 

  But we think there is something else going on here that has everything to do with the excuses proffered by those who choose not to directly challenge Roe v. Wade including Georgia’s Catholic bishops. It is clear that personhood is where Roe v. Wade is most vulnerable. But in order to challenge the Court on that critical point, one must have fortitude. One must exhibit the commitment to go against all the odds, all the polls, all the legal opinions and stand up for the truth as it is. Such heroic action requires boldness, not a spirit of timidity.

  The prosecutors are appealing a ruling from the Military Judge denying the government the outakes of the 60 Minutes interview of Wuterich.  The judge said it was a "fishing expedition."  It is EXTREMELY RARE for the government to appeal a judge's ruling in trial.  It shows either the government's case is very weak and they are not confident in their evidence and case as a whole a week before trial, or they think there is some admissions in the outakes.  Most likely, it is the former.

  Also, apparently they use a Washington Post reporter--Josh White to speak for the prosecution.  Not sure the prosecution needs to have their side spoken for since Josh and Rep Murtha have already done a more than adequate job at that, but a reporter is supposed to be neutral, and like Josh himself says--his reporting looked like it had taken a side--which he regrets?

  This is really hard to believe--the prosecutors are trying to supress the testimony of Maj Dinsmore--the intel officer of 3/1 at the time of the Battle of Haditha.  Maj Dinsmore was the officer responsible for the Marines to know what intel was out there in Haditha at the time and what to be on the look out for. 

  Phil Brennan at Newsmax does another great job in reporting this shocking story.  Read it here.  How the prosecutors do not think this would be a violation of LCpl Tatum's and SSgt Wuterich's due process rights is beyond me.  Hopefully the military judge will rule correctly in this instance and allow the evidence before a jury.  The mindset of the Marines on the ground at the time is critical to their defense and the prosecutors want to supress this?????

  One earmark provides $243,000 in taxpayer dollars for the organization Chez Panisse <http://www.chezpanisse.com/>  to create gourmet organic school lunches in the Berkeley School District.  Chez Panisse is dedicated to "environmental harmony" and their menu features "Comté cheese soufflé with mâche salad," "Meyer lemon éclairs with huckleberry coulis," and "Chicory salad with creamy anchovy vinaigrette and olive toast."
  
  Another earmark would spend $975,000 in taxpayer dollars for the University of California in Berkeley Matsui Center for Politics and Public Service, to create a new endowment and cataloging the papers of Congressman Robert Matsui.  U.C. Berkeley currently already has a $3.5 billion endowment.
   
  Senator Inhofe: "Unfortunately, those on the Berkeley city council do not seem to understand the sacrifice of the brave men and women of the United States Marine Corps. By interfering with military recruiting, the city of Berkeley is hampering our ability to protect this nation.   This is great news and proves that the pro-life movement and it's positive message on a culture of life works.  It also proves that more education and better science doesn't translate into more abortions, but less.  Why?  because women understand more than ever that abortion kills a human being.  With 4D ultrasound and understanding the begining of life better scientifically one cannot put the blinders on any longer and rely on the empty rhetoric that we just don't know when life begins or it's not really a human.   Read the article here. 

  It's still disappointing that the writers of this article and the people behind the study try to explain away these results with everything but the obvious that Americans generally do not want to kill their children.

  We did not know that the Catholic Church has moved or translated the date of the Feast of Saint Patrick from march 17. 2008 to March 15, 2008.  This is because the 17th falls within Holy Week.  Now the only problem is they moved Saint Patrick's Day to  Friday during Lent (no meat!).  Some local bishops have already gave dispensations (with a make up day).

  Probably a good idea to move the date--won't happen again for another 100 years.  Easter is early this year.  Read a story about it here.

  SSgt Wuterich has FINALLY been charged by the government--unfortuanately.  The Marine Corps released this information on New Year's Eve BTW (wonder if many people heard???).   What SSgt Wuterich was charged with was "Manslaughter."  Doesn't take a lawyer to figure out that is NOT MURDER.  Our point is that the government originally charged murder of these Marines.  None of these charges stood up.  The government and presses theory of a revenge massacre was bogus from the beginning and this proves it.  None of these Marines should be charged with anything, but they are in face saving mode--in our opinion.

  With all that said, LtCol Chessani now is officially charged with not thoroughly investigating and reporting a "massacre" that never occurred--AND THE GOVERNMENT IS STILL MOVING FORWARD WITH THIS LEGAL FICTION.

  Word is that SSgt Wuterich and his attorneys are demanding a speedy trial, so he could go first.  If all goes as it should, he will be the first acquitted and exonerated!
